LANDOWNERS DESERVE ANSWERS

PROF. LEX’S CORNER • DOCUMENTARY EVIDENCE ISSUE • 15 OCTOBER 2026 • EVI–SSEA–01

John Tait | Watershed Debacle Enquiry

SSEA’s response to an FOI request, its published commitments, and the questions facing Severn’s representative.

SIX QUESTIONS. SIX ‘NO’ ANSWERS. Who examined the costs to affected private landowners?

What the record establishes

On 14 October 2026, Julie Cayley, Executive Director of the Severn Sound Environmental Association (SSEA), answered NO to all six questions about records concerning private-landowner impacts in Severn. The questions covered compensation, permitted uses, parcel values, responsibility and direct notification. Mark Taylor was copied on both the request and her reply. [E1–E2]

Our assessment: this is a serious gap in the documentary account supplied to landowners. The next step is to establish what was searched, what work exists, and who was assigned responsibility. A statement that no responsive records were located does not itself show that records were withheld or that someone lied.

The actual Cayley response

Subject: RE: Julie Cayley and SSEA — YES/NO response and MFIPPA request on private-landowner losses

Mr. Tait, Thank you for your email. The answer to questions 1 through 6 is NO. The SSEA has no response of records. Kind regards Julie Julie Cayley BSc (Hons), P.Ag. Executive Director

Reading copy of the retrieved email. Wording is retained, including “no response of records.” Contact details and repeated quoted history are omitted; line wrapping is normalized. Her intended meaning for that unusual phrase remains to be clarified. The complete retrieved correspondence is retained in our private source file.

What the six answers were about

The original question was: “As of October 4, 2026, does SSEA hold any record concerning Watershed, Greenlands or natural-heritage planning affecting private land in Severn that documents:” [E1]

Question in the request

Cayley’s collective answer

1. Consideration of compensation for affected private landowners?

NO

2. A study of the effects on permitted uses of an individually identified private parcel?

NO

3. An appraisal or analysis estimating the resulting change in an individually identified private parcel's market value?

NO

4. A proposed or approved compensation process for those effects?

NO

5. Assignment of responsibility for assessing those private-landowner losses or funding compensation?

NO

6. A procedure for directly notifying affected owners about the effects on their individual parcels?

NO

The NO entries above apply Cayley’s single answer to questions 1–6; she did not send six separately numbered answers. The request defined NO as no record located after a reasonable search. It expressly recognized that another institution might hold records and that discussions might have occurred without a located record. [E1–E2]

The mandate provisions that deserve an answer

The published 2009 Letter of Agreement, in the amended copy currently linked by SSEA, contains these provisions. The references identify that published version; they are not presented as a verified consolidation of all 2026 amendments. [S1]

Published agreement provision

What it assigns

Our question

Section 3.1.8 • PDF page 8

The Executive Director must “ensure public involvement is maintained as an integral part of the operation of the SSEA”.

How were affected private owners included when their parcel concerns were raised?

Sections 2.9 and 2.13 • PDF pages 6–7

The Board must keep municipalities informed and implement the strategic and business plans, subject to the agreement’s approval wording.

What did Severn’s representative bring to the Board, and what was reported back?

Sections 3.1.4–3.1.6 • PDF page 8

The Executive Director must report annually on progress, give quarterly municipal updates and provide briefing notes as required.

Which reports addressed these concerns or identified the body responsible for them?

Version check: Cayley’s 14 April 2026 briefing note reports Board approval of administrative agreement updates on 29 January 2026 and says the changes retain the original intent. The fully executed current agreement and any changed numbering should be supplied for a definitive current-duty comparison. [S2]

The strategic-plan commitments beside the six NO answers

The following references are to SSEA’s Strategic Plan 2024–2029. Page numbers are the printed numbers; the PDF viewer is one page higher. [S3]

Provision

Commitment and question

LEAD 2(p), printed p. 30

“Undertake a comprehensive analysis of the economic, social and environmental costs and value associated with effective watershed protection and management”. Has that work begun, and does it include costs borne by private owners?

EMPOWER 1(a), printed p. 25; EMPOWER 2(a)–(b), p. 26

The plan provides for engagement and support for landowner environmental projects. What route lets affected owners raise parcel-impact concerns? Stewardship support is not a compensation promise.

Corporate values, printed p. 13

The plan commits to fair treatment, transparency, objective expertise and responsive service. How will SSEA explain its search and the responsibility gap?

Progress reporting, printed p. 33

The plan connects implementation to Board reports, budgets and an annual public report. Where is progress on the economic-cost analysis recorded?

These commitments justify scrutiny. They do not, by themselves, require individual appraisals or compensation, prove a contradiction, or establish a breach. Work that values watershed benefits may have a different scope from the parcel-loss records requested.

Mark Taylor: the accountability question

SSEA’s current Board listing identifies Councillor Mark Taylor as Severn’s representative and an executive committee member. That makes his response to these concerns a legitimate public question. The email headers establish that he was copied; they do not prove he read, approved or directed Cayley’s answer. [E1–E2; S4]

No separate response from Taylor to these six questions was located in the connected mailbox search completed on 15 October 2026. That limited search is not proof that he never acted elsewhere.

COUNCILLOR TAYLOR: What did you ask, what did you bring back to Severn, and where can landowners read the record?

What Cayley’s email leaves unanswered

  • Who conducted the search, when, and which files, email accounts, former-personnel records and contractor-held records were covered?

  • Does the answer cover Part B’s detailed records request as well as Part A’s six questions?

  • If another body is responsible for studying parcel effects or compensation, which body is it, and where is that assignment recorded?

  • What records show the scope, timetable, funding and progress of the economic-cost analysis?

  • Who is SSEA’s designated MFIPPA head or delegate, what is the request’s formal status, and what are SSEA’s application-fee instructions?

The original request said that application fees had not yet been remitted. The reply reproduced here gives no SSEA file number, search description, fee instructions or appeal information. We therefore describe it as Cayley’s response to the request, without declaring it a completed statutory refusal or an unlawful denial. The County of Simcoe’s separate fee correspondence does not settle SSEA’s processing status. [E1–E2]

The original email — so readers can judge the scope

Subject: Julie Cayley and SSEA — YES/NO response and MFIPPA request on private-landowner losses

Dear Ms Cayley,

Please personally review and confirm SSEA's response to this request in your official capacity. I am copying Mayor Mike Burkett, Alison Gray, Councillor Mark Taylor, Patrick Trafford and Katie Mandeville, with the relevant records offices.

WHY THESE ANSWERS MATTER

Our independent Watershed Debacle enquiry is examining whether environmental and planning work affecting private parcels in Severn has been accompanied by examination of landowners' permitted uses, possible financial losses, notification and compensation. This forms part of our “Mission Creep Expansion on the Watershed Enquiry.”

The purpose is to establish what was examined, by whom, and who was assigned responsibility. We seek records that support or contradict our concerns.

PART A — YES OR NO RESPONSE FROM SSEA

For each question below, please enter YES or NO only on the answer sheet. Put supporting records, necessary qualifications and statutory access decisions in a separate response. Please identify the person confirming the answers, their position and the date.

As of October 4, 2026, does SSEA hold any record concerning Watershed, Greenlands or natural-heritage planning affecting private land in Severn that documents:

1. Consideration of compensation for affected private landowners? YES / NO 2. A study of the effects on permitted uses of an individually identified private parcel? YES / NO 3. An appraisal or analysis estimating the resulting change in an individually identified private parcel's market value? YES / NO 4. A proposed or approved compensation process for those effects? YES / NO 5. Assignment of responsibility for assessing those private-landowner losses or funding compensation? YES / NO 6. A procedure for directly notifying affected owners about the effects on their individual parcels? YES / NO

For this answer sheet, YES means at least one responsive record is held; NO means none was located after a reasonable search. A NO does not establish that no discussion ever occurred or that no other institution holds records. Any unanswered item will be recorded as unanswered.

PART B — FORMAL REQUEST FOR RECORDS UNDER MFIPPA

I request access under the Municipal Freedom of Information and Protection of Privacy Act. This part is addressed separately to SSEA through Ms Cayley and its designated head or delegate; the Township of Severn through Ms Gray and the Clerk's office; and the County of Simcoe through Mr Trafford and the Clerk's Department. Each institution is asked to process the records within its own custody or control and issue its own access decision.

Please provide:

A. Existing studies, appraisals, valuation methods, calculations, instructions and contracts addressing the parcel effects in questions 2 and 3. Include recorded authors, commissioning bodies, funding sources and approvals.

B. Records documenting consideration, approval, rejection, deferral or referral of compensation, including proposals, policies, funding arrangements, minutes, briefing notes and correspondence.

C. Agreements, delegations, terms of reference, resolutions or instructions assigning responsibility for parcel-impact studies, valuation, compensation or landowner notification, including any reassignment between SSEA, municipalities, the County or a provincial ministry.

D. Direct-notification procedures and the notices, distribution records or decisions to provide or decline notice concerning the parcel effects described above. Unrelated owners' personal contact information may be severed.

Scope: Severn private parcels affected by Watershed, Greenlands or natural-heritage planning. Include related IGAP, shoreline, Tea Lake or Cumberland quarry material only where it addresses these specified parcel-impact, compensation, responsibility or notification issues.

For studies, policies and governing instruments, the period is January 1, 2010 to October 4, 2026; include earlier instruments operative during that period. For correspondence, minutes and briefing notes, the period is January 1, 2023 to October 4, 2026.

Please search relevant institutional files, including responsive records held by current or former personnel and by contractors where within your institution's custody or control. Please preserve responsive records during processing and any appeal.

Electronic copies are preferred, with existing dates, authorship and email attachments retained. I seek records, not a newly commissioned study or legal opinion. Please release reasonably severable non-exempt portions. For each category where no records are located, say so expressly and describe the search undertaken. For withheld material, provide the applicable statutory grounds, reasons and appeal information.

Ms Cayley, please identify SSEA's designated MFIPPA head or delegate and arrange delivery to that person. If an institution disputes jurisdiction or custody or control, please state its position in writing and address any applicable forwarding or transfer procedure.

Please acknowledge receipt, identify each file number and confirm payment instructions for each institution's $5 application fee. Those fees have not yet been remitted. Please provide any required processing-fee estimate before undertaking substantial chargeable work and contact me if clarification would permit a more focused search.

Yours sincerely,

John Tait Watershed Debacle Enquiry

What we are asking for

Publish the relevant records. Explain the search. Identify who owns each responsibility. If work is planned, give its scope and timetable. If it was assigned elsewhere, identify the receiving institution and the record of that assignment.

Our view: a NO answer may be accurate and still leave a troubling question—why was the information not there? Environmental protection and candid examination of private-landowner costs belong in the same public discussion.

SHOW LANDOWNERS THE WORK. If no work was done on these parcel issues, explain who was responsible for considering them.

Corrections and documented responses from SSEA, Councillor Taylor or the municipalities are welcome at info.watersheddebacle@gmail.com. Any new evidence will be dated and assessed against this record.

Source record: E1 and E2 are the retrieved 12 and 14 October 2026 emails, checked against the saved EVI FOIA evidence assessment and the connected mailbox on 15 October. S1–S4 are the official publications linked above. This issue addresses SSEA’s response; the Severn fee and records-index dispute will be examined separately.

PUBLIC BENEFIT DESERVES PUBLIC ACCOUNTABILITY

PUBLIC ACCOUNTABILITY REMINDER | 15 OCTOBER 2026

WE PAY. GOVERNMENT IS US.

Taxpayers fund municipal decisions. Landowners may pay again to obtain records, challenge decisions and prove losses. Public money may also fund the defence of claims alleging municipal negligence.

What was spent on preventing disputes, correcting proven errors and reaching fair resolutions—and how does that compare with litigation?

PUBLIC MONEY. PUBLIC RESPONSIBILITY.

Severn example — By-law 2021-13, sections 3–4: conditional indemnification for qualifying official acts or omissions, including inadvertence or good-faith errors of judgment, subject to insurance limits. Whether a particular claim qualifies requires evidence.
