Re: Request for Access to Records under the MFIPPA – Supporting Class Action & Property Encumbrance Inquiry.



Dear FOI Coordinator,


Pursuant to the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), I hereby request access to the following records in relation to watershed encumbrances, Greenland zoning designations, and administrative actions affecting private land in the Township of Severn.

Requested Records: All communications, reports, memos, emails, maps, and internal correspondence (including attachments) between the Planning Department, Council, CAO, and any conservation authority regarding the justification for:  Greenland zoning, watershed overlays, environmental encumbrances, or protected areas designated on private lands; all documents in Severn township involving development proposals on designated Greenland zones from January 1, 2018 to this date.

Any by-laws, council resolutions, planning reports, or studies authorizing or implementing watershed zoning or Greenland overlays on private lands, including any rationale, scientific data, or third-party assessments and the authors of such.

Any complaints, appeals, or correspondence from landowners regarding such designations or zoning restrictions, and the municipal response thereto.

All records of discussions or legal advice sought or received (excluding redacted solicitor-client content if applicable) pertaining to the legal implications, compensation concerns, or expropriation risk assessments involved in any of these encumbrances.

Any records, forms, or policy documents used to notify property owners of zoning designations or to consult them in advance of this encumbrance and the mailing addresses of all the watershed affected private landowners in Severn.

All documents pertaining to tree harvesting inquiries denied due to Greenland encumbrances.                                                    

Records relating to assessments of property value impacts, tax adjustments, or compensation schemes resulting from the application of Greenland or watershed zoning on private lands.

A map or PIN numbers of all Greenland affected private properties in Severn.

All communications with the following bureaucratic individuals and their ministries, regarding retraction of the watershed/wetland encumbrances on private properties and their  affiliation with third party unelected self-described legislators; and their positions on this encumbrance. Any documents indicating who these unelected legislators are. We elected you not them.

 NOTE:  The following list was supplied by Secretary Alison Gray and Mayor Mike Burkett following a meeting at the Severn offices. In their favor, we were assured by both that they had dealt with the below named, over this Watershed debacle. We supplied council with Kicklei.ca simple protocols to remove Severn from intrusive legislation.

Under tort law any damage done to a property owner requires compensation.

NOTE: Council may choose to sue the following for placing the mayor, councilors and administrative staff of council and planning in a precarious position according to the Supreme Court findings.

Fee Waiver Request: As these records are intended to be used in support of multiple

affected landowners and potential class litigation involving public interest and accountability, I respectfully request consideration of a fee waiver under Section 45 of MFIPPA

If any portion of the records must be withheld or redacted under MFIPPA exemptions, please provide a full index of records and reasons as per Section 29 of MFIPPA
