FORMAL NOTICE OF NO TRESPASS / NO ENTRY

AND NOTICE OF EVIDENTIARY PRESERVATION IN PENDING LITIGATION

Dear Municipal Officials,

I, the undersigned, am the legal and registered owner of the private property municipally known as: 2715 Janes Lane, Coldwater On.

Legal Description; con.3 Pt lots 13&14

This letter constitutes a formal legal notice of NO TRESPASS and NO ENTRY, and is issued in relation to ongoing legal proceedings involving your municipality and the undersigned. The subject matter of the dispute concerns alleged damages, devaluation, and encumbrance arising from the imposition of a wetland or watershed designation or mapping on privately held lands.

1. EVIDENTIARY PRESERVATION –   POTENTIAL LITIGATION

Be advised that the above-noted property, including its natural features, land formations, vegetation, topography, drainage patterns, and hydrological context, constitutes critical and material evidence in the forthcoming litigation against the Township of Severn. Any disturbance, inspection, or modification of the land—whether intentional or incidental—may constitute interference with judicial evidence and result in claims of spoliation and obstruction of justice.

2. NO ENTRY WITHOUT COURT ORDER OR EXPRESS CONSENT

Effective immediately, no person acting in any official, administrative, enforcement, or inspection capacity for or on behalf of the Township, including staff, contractors, officers, elected officials, or agents, shall:

  • Enter upon the property;

  • Conduct inspections, surveys, data gathering, or drone use;

  • Collect or disturb any material, soil, vegetation, or water;

  • Undertake any enforcement actions related to planning, conservation, or by-law complaints;

Unless explicitly authorized by:

  • A valid and specific court-issued warrant or;

  • Prior written permission from the property owner.

3. TRESPASS AND LIABILITY NOTICE

Unauthorized access shall be treated as trespass under the Trespass to Property Act, R.S.O. 1990, c. T.21, and may further give rise to:

  • Civil proceedings for damages and injunctive relief;

  • Personal and institutional liability for misfeasance in public office;

  • Adverse evidentiary inferences in the litigation;

  • Formal complaints to the Office of the Integrity Commissioner, Ombudsman of Ontario, and other oversight bodies.

This letter constitutes formal written notice. All municipal departments and staff are hereby directed to refrain from entering or engaging with the subject property in any capacity until such time as the litigation has been resolved, or proper judicial authority has been granted.
